Terms and Conditions
Please thoroughly review these terms and conditions of OnePulse Travel and onepulsetravel.com, herein referred to as "OPT", “we” or “us”. By booking a service or travel component with OPT, paying a deposit, or signing the travel service agreement, you accept all of the terms in this agreement on your own behalf and on behalf of all persons listed on the booking, including but not limited to any Minors for whom you are signing this agreement (also referred to individually as “Traveler” or “Travelers”), and direct us to perform services for each and every Traveler.

TRAVEL AGENT: OPT is simply an intermediary between the Suppliers and traveler and acts solely as a booking agent for disclosed principal supplier cruise lines, hotels, airlines, air charters, bus companies, ground transportation, boat purveyors or owners, and other independent contractors providing accommodations, transportation, and/or other services (“supplier(s)”) and is not the source or provider of the travel services. Our obligation to you is to book travel on your behalf and to arrange relevant contracts between you and the travel service providers. Each of these supplier companies is an independent entity with its own management and is not subject to the control of OnePulse Travel. Customer is advised that the suppliers whose names appear in travel documentation are those responsible for providing the travel services purchased, and consents to the use of those suppliers, and understands and agrees each supplier’s Terms and Conditions are provided to customer in printed or email form. BECAUSE OPT ACTS AS AGENT FOR DISCLOSED PRINCIPAL SUPPLIERS AND DOES NOT HAVE THE RIGHT TO CONTROL THE OPERATIONS OF SUCH INDEPENDENT OPERATORS AND SUPPLIERS, YOU AGREE OPT IS NOT LIABLE FOR ANY PERSONAL INJURY OR PROPERTY DAMAGE, WHICH MAY ARISE OUT OF THESE SERVICES..
BOOKING ACCURACY/LEGAL NAMES: Passenger is required to immediately review all aspects of their booking to verify (but not limited to): passenger names, mailing address, email address, telephone number, date of birth, pricing, airfare, arrival/departure airports, accommodations, and organized activities on your booking receipt. Please notify OPT immediately if any omissions and/or corrections are needed regarding the booking details. Passenger(s) voluntarily assumes full & sole responsibility for any and all risks and/or costs involved with failure to report such errors and/or omissions. Passenger is required to verify the accuracy of the passenger’s LEGAL first & last names. It is mandatory that guest names be identical to the Passenger(s) LEGAL first and last names and identical to the names as they appear on booking and travel documents.
PRICING: Prices and availability quoted by OPT are not guaranteed until deposit is fully paid. Pricing and availability may change without notice. Passenger agrees that OPT is not responsible for any errors or omissions in any quotes, advertisements, including on our website, resulting in inventory, content, or pricing discrepancies nor is OPT responsible for any errors or omissions that may occur as a result of incorrect information from third parties. Suppliers reserve the right not to honor any published prices that it determines were erroneous due to electronic, printing, or clerical error. You acknowledge this right and agree to hold OPT harmless for any actions or damages arising from Supplier pricing. OPT reserves the right to charge Passenger(s) for any increase in taxes, fees or surcharges (i.e. fuel). Passenger(s) acknowledge this right and agree to pay any such additional taxes, fees, and surcharge.
PAYMENTS: OPT accepts Visa, American Express, Discover, and Mastercard. OPT holds reservations until “Deposit Due Date” indicated on your confirmation. If deposit/payment is not received by OPT on or before the Deposit Due Date, reservations are automatically cancelled. Failure to remit payments on a timely basis will automatically put your booking at risk of cancellation. Payment extensions are at the sole discretion of the supplier, and they are mostly not always granted. Please contact us immediately, and in advance of your payment due date, if you will be unable to meet this obligation. Without limitation, Passenger(s) voluntarily hold OPT harmless for cancellation of any booking for either late payment or declination of a credit card.
PAYMENT METHODS: We use third party payment processing companies (e.g. TravelJoy, PayPal). This will allow our clients to make payments through TravelJoy or PayPal with any major credit cards or debit cards. Payments are made online via your personal invoice. We do not accept payments by phone.
TRAVEL DOCUMENTS: It is the responsibility of each Client to obtain and carry a valid passport, visa(s), and all other documents required by applicable government regulations. The name, date of birth and gender that appears on the passport must exactly match the same such data that is listed on booking records. OPT strongly recommends that you consider that certain countries will not admit a passenger, if their passport expires within six (6) months of the date of entry. Non-United States citizens may require additional documentation. When you receive all travel documents, it is the sole responsibility of the customer to review and verify all information. Contact OnePulse Travel immediately if changes or corrections are required.
CANCELLATIONS: All cancellations or no-shows are subject to penalties imposed by the supplier. You will receive a copy of such terms prior to booking with OPT. All cancellations must be submitted in writing and emailed to info@onepulsetravel.com. Cancellations sent to any other address will not be processed. Upon making the booking, Passenger(s) hereby accept & acknowledge liability for all cancellation fees imposed by the supplier. Cancellations are posted on day that the complete cancellation documents are received by OPT.
If multiple people are on a reservation and one person needs to cancel, the trip will need to be rebooked and will be requoted at the current rate. This may mean an increase in the rate for those that are remaining on the reservation. It is the responsibility of the travelers within the same reservation to ensure payments are being made.
RESERVATION CHANGES: All requests to make changes to a reservation must be made in writing and emailed to info@onepulsetravel.com. There is a $25 per reservation fee to research any changes to your reservation after booking. Examples of a change request that will incur a change fee include, but not limited to, the following requests: 1. Room type; 2. Hotel change; 3. Flight change; 4. Cabin change on airline (i.e moving from coach to another class of service); 5. Changing dates of travel; 6. Adding passengers to reservations; 7. Removing passengers from reservations. *Please note that name changes to airline reservations are subject to full cancellation and rebooking. Replacing a traveling passenger with another traveling passenger constitutes a cancellation, subject to cancellation penalties, and is not covered by this Reservation Changes policy. Changes or additions after departure are subject to local rates at the time of amendment and must be paid directly by the passenger to the service provider. There are no refunds for unused services.
TRAVEL PROTECTION: Travel insurance protection is Strongly Recommended. As your travel agent, we have a professional responsibility to recommend the purchase of travel protection to protect both you and your vacation.
By declining travel protection, you acknowledge and accept liability for any cancellation penalties, damages and/or out–of-pocket expenses incurred. You also acknowledge and accept responsibility for arranging and paying for any treatment in case of a medical emergency while traveling. Please note that if you decline this type of coverage, you have waived your right to this important coverage and your confirmation will note “declined” next to the travel protection section of your confirmation. If you HAVE purchased travel protection, please remember to review your confirmation for accuracy and call us immediately if you believe you have travel protection and your confirmation indicates declined. Failure to contact us will be considered waiver of travel protection.
We urge you to read your policy when it arrives as it contains important information. This information includes, but is not limited to, details on the extent of coverage and procedures for making a claim.
All requests for service under the policy must be filed directly with the travel insurance provider, in accordance with the policy terms and conditions, which you the passenger are responsible for reviewing upon receipt of your travel protection policy. OPT is not able to give advice with regards to possible cancellations and any associated claims processing. All queries regarding cancellation, penalties, coverage should be directed to your travel insurance provider. Please note that the travel insurance provider may not be allowed to discuss your claim with OPT due to privacy laws (e.g. HIPAA). Accordingly, you acknowledge that OPT cannot be involved in any aspect of your claim/request for service. Passenger(s) acknowledge and agree that OPT has no control over the travel insurance provider or its coverage decisions, and as a result OPT is not responsible for and shall not be liable for policy coverage, claims processing, or the denial of any claims.
AIRLINES: OnePulse Travel is not responsible for the services and policies imposed by the airlines. Airline schedules and flights are subject to change without notice. In the event of an airline schedule change, OPT will make every effort to inform passengers of the schedule change and new flight schedule prior to departure.
CONTACT INFORMATION - Pursuant to TSA Secure Flight requirements, passengers are responsible to provide OPT with their name as it appears on their passport (or other government-issued I.D. when traveling), date of birth, gender, address, phone number, email and provide data for all passengers. Passengers must ensure that names are correctly listed on their invoice. OPT will not be responsible for passengers who have received their invoices or documents but are denied boarding due to inaccurate information.
AIRLINE NAME CHANGES - Any name change including minor spelling corrections may require airline reservations to be canceled and rebooked. Reservations are subject to current availability and pricing at the time of rebooking. Once airline tickets are issued, subsequent name corrections will be subject to an airline rebooking fee which may be as much as the full value of the airline ticket plus a $50 revision fee per change. OPT will not be held responsible for the denial of services by a carrier due to any name discrepancy. Name changes must be advised in writing at info@onepulsetravel.com.
LUGGAGE (AIRLINES) - Checked bags are typically limited to a total dimension of 62 inches by adding length + width + height (example: 26"+26"+10" = 62”), and a maximum weight of 50 lbs (23kg). Many airlines apply charges for checked bags. OPT is not responsible for checked bag fees, excess luggage or weight charges levied by an airline. If your luggage is lost or damaged by the airlines, a baggage claim form MUST be filed with the carrier before leaving the airport. We recommend that you use brightly colored luggage tags, straps or other identifiers to help you locate your luggage upon arrival or to describe it if it is lost.
LIMITATION OF LIABILITY: Without limitation, Passenger(s) assume the risk of, and agree that OPT is not liable for any damages arising from or related to any act of God or public enemies, arrest, restraints of any government or rulers of people, piracy, war, revolution, extortion, terrorist activity, threatened or actual rebellion, political upheaval, civil unrest, riots, fire, lockouts, explosion, collision, weather conditions, dangers incident to the sea, mechanical or construction failures or difficulties, diseases, local laws, abnormal conditions or developments, closure of airports/seaports/hotels/train stations, carrier or supplier logistical problems, computer problems stranding, food or water poisoning, illness, grounding, perils of the sea, rivers, canals, locks or other waters, perils of navigation of any kind, theft, accident to or from machinery, boilers, or latent defects even though existing at commencement of the trip, desertion or revolt of crew, or lost/damaged/delayed luggage.
MODIFICATION OF TERMS AND CONDITIONS: The Terms and Conditions may be amended or modified by OPT at any time without notice. It is therefore essential that you consult the Terms and Conditions prior to making each and every booking, particularly in order to ensure what provisions are in operation in case they have changed since the last time an order was placed by you.
Only those who have accepted the Terms and Conditions and affirmatively indicated their consent to be bound by the Terms and Conditions may make a booking with OPT. Without this acceptance any order is subject to cancellation at any time.
The failure of OPT to act with respect to a breach of these Terms and Conditions by you, or others, does not waive its right to act with respect to subsequent or similar breaches. OPT does not guarantee that it will take action against all breaches of this these Terms and Conditions.
SEVERABILITY: If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.
HEADINGS: Headings are for reference purposes only and do not limit the scope or extent of such section.
MANDATORY ARBITRATION / FORUM / CHOICE OF LAW: The Parties hereby agree that any and all disputes arising out of or relating to this Agreement shall be submitted to final binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association and shall be governed by the laws of the State of Texas. The Parties agree that the arbitration shall take place in Harris County, Texas and will be conducted by a single mutually agreed upon arbitrator. The arbitrator shall permit both sides to conduct reasonable discovery, in her/his sole discretion, and shall render a written award. Payment of the cost of the arbitration, including the arbitrator’s fees and room rental, shall be split equally between the Parties. Judgment upon the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.
The Parties acknowledge and agree that this arbitration is their sole recourse and that they may not file a lawsuit against OPT. If Passenger(s) fails to submit their claim to arbitration and instead files suit, OPT shall be entitled to recover its attorney’s fees and other costs incurred in the enforcement of the terms of this Agreement, including costs incurred seeking referral to arbitration. Passenger(s) and OPT agree that neither party shall be entitled to join or consolidate claims or arbitrate any claim as a representative or class action.
COVID-19 WAIVER OF LIABILITY: In Spring 2020, the World Health Organization (WHO) declared the Novel Coronavirus (COVID-19) a worldwide pandemic. The Center for Disease Control (CDC) issued several preventative measures to combat the virus, such as frequent hand washing, wearing a mask or face covering and keeping at least 6 feet away from others. If contracted, this virus has the ability to cause the traveler serious and severe illness. For more information on the COVID-19 virus, please visit the CDC webpage at www.cdc.gov.

COVID-19 is a highly contagious virus that can be spread via person-to-person contact.
After reasonable inquiry, OnePulse Travel provided me with the best available information regarding the pandemic-protective policies and practices of the vendors and suppliers in my travel itinerary.
Supplier(s) of OnePulse Travel may have policies in place to help prevent the spread of COVID-19. OnePulse Travel is not the drafter or holder of those policies and I understand that these policies can change at any time.
I understand that the supplier(s) may not apply those policies as diligently as the policies suggest and even if the supplier makes a good faith effort to enforce its good practices, some travelers may simply refuse to cooperate.
. I understand that each state/country institutes their own pandemic-protective policies and regulations. I further understand that I am responsible for knowing, understanding and abiding by the pandemic-protective policies and procedures regarding COVID-19 of all states/ countries listed in my travel itinerary, including any policy updates. I also understand that I may be denied entry into the country for reasons within or outside of my control.
I understand that by traveling, I can be subject to voluntary or involuntary quarantine either at home or in the traveled location(s).
I am responsible for knowing, understanding and abiding by the pandemic-protective policies and procedures regarding COVID-19 of all vendors used in my travel itinerary, including any policy updates.
With full awareness and appreciation of the risks involved, I assume all risks of travel and hereby forever hold harmless, waive, discharge, and release OnePulse Travel from any and all liability, claims, demands, actions, and causes of action, directly or indirectly arising out of or related to any loss, damage, or injury, including death, that may be sustained by me related to COVID-19 whether caused by the negligence of the Released Parties or any third-party vendor or supplier partnering with OnePulse Travel.
I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all costs, expenses, damages, claims, lawsuits, judgments, losses, and/or liabilities (including attorney fees) arising either directly or indirectly from or related to any and all claims made by or against any of the Released Parties due to bodily injury or harm, death, loss of use, monetary loss, or any other injury from or related to my use of OnePulse Travel’s services or the services of suppliers/vendors, specifically related to Covid-19.
